  Law requirements

Article I of Directive 2006/42/EC identifies equipment that must be considered "machines" and lay down its compliance with essential safety and health. The machine is checked by one of evaluation procedures described in Article 12 that indicates how the manufacturer has to place their products on the market.

The European Directive
Directive 2006/42/EC came into force on 29/12/2009. The CE marking is a mandatory requirement and compulsory for the marketing machine. The Directive requires manufacturers to affix on the machines they made the CE marking and draw up the declaration of conformity, attesting to the compliance with essential safety and health requirements as defined in the Directive. The directive also applies to safety components that are placed on the market separately.

Procedures for Certification
The new Machinery Directive distinguishes two groups of machines in Annex IV; the first group involves the machines not in fully compliance with the harmonized standard or in the absence of harmonized standards. The manufacturer, in this case, is obliged to request the intervention of a Notified Body to perform:
- The EC Type Examination and internal control of production;
- The procedure of full quality assurance;

The second group includes machines manufactured in full compliance with the harmonized standard. The manufacturer, in this case may follow a choice between the following options:
- The procedure for assessing compliance with internal control on the manufacture of machinery;
- The EC Type Examination and internal control of production;
- The procedure of full quality assurance;
For machines not belonging to Annex IV which is not requested the intervention of a Notified Body, the manufacturer can still voluntarily submit the technical file of the machine to ECO Certificazioni SpA, as a third entity, independent, who will issue a certificate of compliance to applicable standards or to the Directive, useful for CE marking and for marketing its product.

  Obligation addressees

All machine manufacturers, importers or their representatives are required to put the CE mark on products and to declare the conformity (CE declaration of conformity), to produce the technical file of the product. For all machines "dangerous" included in Annex IV of the Directive (eg lifting people, presses, saws, etc..) Prior to being marketed, the manufacturer must follow one of the above mentioned options.
