  Law requirements

Article I of Directive 98/37/EC identifies all equipments which must be considered ‘machineries’ and establishes the observance of essential safety and health requirements. Machineries are verified through the application of evaluation procedures as described in article 8, allowing manufacturers to affix the EC mark and to commercialize their products.

The European Directive
Directive 98/37/EC was implemented by our legal order through D.P.R. 459/96.
With European Directive 98/37/EC coming into force, EC Certificates represent a cogent requirement, compulsory for the commercialization of all machineries.
The Directive calls on all manufacturers to affix the EC mark on their machineries and to draw up a compliance declaration, attesting observance of essential safety and health requirements defined by the directive itself.
The Directive also applies to safety components launched separately on the market.

Certification procedures

The directive distinguishes two groups of machineries:
The first group collects all machineries listed in attachment IV and considered most dangerous.
Manufacturers are obliged to request the intervention of a Notified Body for it to perform:
• EC Type Examination, when machineries have not been realized in full compliance with harmonized standards
• a choice of the following possibilities, when machineries have been built in full compliance with harmonized standards:
- EC Type Examination
- Inspection of the Technical File
- Conservation of the Technical File

The second group gathers all other machineries. Intervention of a Notified Body is not compulsory; manufacturers may however volunteer to have their machineries or technical file checked by a Notified Body, who will issue an EC certificate.

  Obligation addressees

All machinery manufacturers, importers or agents are obliged to affix the EC mark on all products and to draw up a product compliance declaration. The intervention of a Notified Body as ECO Certificazioni is required for all ‘dangerous’ machineries listed in attachment IV of the Directive (e.g. people lifting devices, presses, saws, etc), before their launch on the market.
