  Law requirements

European Directive 88/378/EEC on the Safety of Toys favours the manufacturing and/or importing in the EC field of products responding to minimum safety requirements, erasing the technical barriers that different National regulations had previously set to the free circulation of goods.

The European Directive

Directive 88/378/EEC modified by Directive 93/68/EC applies to toys or any game product conceived for or destined to children under 14 years of age.
It determines the safety criteria or “essential requirements” to which toys need to respond at the moment of manufacturing and before their launch on the market. European normalization bodies have elaborated non compulsory standards, which have been published on the Official Journal of the European Union. However, only the observance of said standards allows to affix on any product the EC mark which guarantees its compliance.
Compliance evaluation procedures for toys are based on the modular approach enunciated in the decision 93/465/EEC of the Commission for EC compliance marking. It is possible to affix on the toy any other trademark, as long as it cannot be confused with the compliance mark. Member States can make provisions for sanctions and dispose the withdrawal from the market of non compliant products or with the EC mark unduly affixed.
